By accessing or using Luvizon ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Luvizon provides a platform for creating personalized video gifts by combining user-uploaded photos, video messages, and music into a compiled video. The Service is available for a one-time fee of £12.99 per video gift created.

3. User Accounts

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You must be at least 18 years old to create an account and use the Service.

4. Content Ownership and License

Your Content: You retain all ownership rights to the photos, videos, and other content you upload to the Service ("User Content"). By uploading User Content, you grant Luvizon a limited, non-exclusive license to:

• Process and compile your content into video gifts
• Store your content on our secure servers
• Display your compiled video to the recipient you designate

Content Requirements: You represent and warrant that:

• You own or have the necessary rights to all User Content
• Your content does not violate any third-party rights
• Your content does not contain illegal, harmful, or offensive material
• You have obtained consent from any individuals appearing in photos or videos

5. Prohibited Uses

You may not use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, or offensive
• Violate any intellectual property rights
• Upload content depicting minors without proper parental consent
• Use the Service for commercial purposes without authorization
• Attempt to interfere with or compromise the Service's security
• Upload malware, viruses, or harmful code

6. Payment and Pricing

The current price for creating a video gift is £12.99. Payment is processed securely through Stripe. By making a payment, you agree to:

• Provide accurate payment information
• Pay all charges incurred under your account
• Our right to modify pricing with notice

7. Refund Policy

7.1 General Policy

All sales are final. Once payment is processed and video compilation has begun, we do not offer refunds. This is because our service involves immediate processing of your uploaded content and delivery of a custom digital product.

7.2 Exceptions

We will provide a full refund in the following circumstances:

• Technical Failure: If we are unable to deliver your compiled video due to technical issues on our end (not including issues with your uploaded content)
• Service Unavailability: If our service is unavailable for an extended period after payment, preventing video compilation
• Duplicate Charges: If you were charged multiple times for the same order due to a payment processing error

7.3 What We Do Not Refund

Refunds will not be provided for:

• Change of mind after payment
• User error in uploading incorrect photos, videos, or information
• Dissatisfaction with the final video compilation (unless caused by technical errors on our part)
• Issues caused by poor quality of uploaded content (blurry photos, low-resolution videos, etc.)
• Videos that have already been successfully delivered and downloaded
• Videos where the recipient has already viewed the gift

7.4 How to Request a Refund

If you believe you qualify for a refund under our exceptions policy:

1. Contact us at support@luvizon.com within 7 days of your purchase
2. Include your order number and detailed explanation of the technical issue
3. Provide any relevant screenshots or error messages

We will review your request within 3-5 business days. If approved, refunds will be processed to your original payment method within 10 business days.

7.5 Preview Before Payment

To ensure satisfaction, we recommend carefully reviewing all uploaded photos, video messages, text, and music selections before completing payment. Once you proceed to checkout, you acknowledge that you have reviewed all content and are satisfied with your selections.

8. Content Storage and Deletion

We store your uploaded content and compiled videos on secure servers. We reserve the right to:

• Delete inactive accounts and associated content after 12 months
• Remove content that violates these Terms
• Set storage limitations per user account

We recommend downloading your compiled videos for personal backup.

9. Intellectual Property

The Luvizon platform, including its design, functionality, and branding, is owned by Luvizon and protected by copyright and trademark laws. You may not copy, modify, or reverse engineer any part of the Service without written permission.

10. Music Licensing

Preset music tracks provided by Luvizon are licensed for use within the Service. If you upload custom music, you represent that you have the necessary rights to use that music in your video gift.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

• Uninterrupted or error-free operation
• That the Service will meet your specific requirements
• The quality or accuracy of AI-generated compilations
• That all content will be permanently stored

12. Limitation of Liability

To the maximum extent permitted by law, Luvizon shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service (£12.99).

13. Indemnification

You agree to indemnify and hold Luvizon harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights

14. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account by contacting us. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your User Content after 30 days
• No refunds will be provided for partial periods

15. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
